We act for clients from Operation X “Stripped by the Tax Agency”
We act for several of the clients in TV 2’s Operation X programme “Flået af Skat”. The cases concern multi-million tax claims by the Danish Tax Agency and citizens’ legal protection.
TV 2’s Operation X has, in the programme “Flået af Skat”, focused on an extensive case complex in which a number of citizens have, over several years, been met with significant tax claims as a result of money transfers that, in our assessment, they did not themselves make.
We have assisted, and continue to assist, several of the people involved in the case complex.
For the affected citizens, the cases have had very serious consequences. It is not only a question of tax assessments amounting to several million kroner. The tax claims have affected their personal finances, housing and daily lives over several years.
Some have had to take extra work as a result of the Debt Collection Agency’s enforcement. Others have had to move to a smaller home or leave Denmark because of a debt they have contested all along.
Multi-million transfers the clients did not themselves make
A central question in several of the cases has been who actually stood behind the money transfers abroad that the Tax Agency subsequently relied on for the assessment.
We have argued that our clients did not make the transactions in question, and that a closer review of the facts and the documentation supports this.
In several of the cases, police investigations have likewise been material to the assessment of who actually stood behind the transfers.
Nevertheless, the tax consequences for several of the citizens have persisted over a longer number of years.
It illustrates a fundamental problem: once a tax assessment has been made, it can be both lengthy and very resource-intensive for the individual citizen to have it changed.
TV 2’s Operation X shed light on the cases
Journalist Steen Schat-Holm and TV 2’s Operation X have investigated the case complex and the consequences that the Tax Agency’s decisions have had for the citizens involved.
The journalistic investigation helped direct wider attention to the cases and to the question of citizens’ legal protection when the tax authorities’ information and assumptions prove to be wrong.
In our view, however, it should not be necessary for a tax case to attract media attention before a citizen’s objections are examined to the bottom.
Income reduced by almost DKK 4 million
On 29 May 2026 we obtained, in one of the cases, a reduction of a client’s income of almost DKK 4 million.
For the individual client, the result is of course decisive.
But the case also raises a broader question of legal protection in tax matters.
When the state raises very significant financial claims against a citizen, equally high demands must be placed on the basis for the decision. That applies particularly in cases where the citizen denies having made the transactions underlying the tax at all.
A tax case can have consequences far beyond the tax
An incorrect tax assessment is not just an amount on a piece of paper.
When a tax claim passes to collection, it can affect almost every part of a citizen’s finances. It can have an impact on disposable income, housing, work and the family’s overall financial situation.
At the same time, a tax case can take several years to conclude.
That places the citizen in a difficult situation. Few have the finances, the time or the legal qualifications to conduct a protracted case against the tax authorities.
This applies not least to citizens who at the same time have limited Danish-language skills or are unable to review extensive bank material, police documents and tax decisions themselves.
Legal protection in tax matters
The Tax Agency’s own motto is: “Tax is not simple. That is why we are here.”
We agree with the first part. Tax is not simple.
That is precisely why it is essential that the authorities are careful with both the legal and the factual basis before making decisions that can have far-reaching consequences for the individual citizen.
Outside this particular case complex, we also see tax cases where citizens must go through several administrative instances, and in some cases the courts, before a wrong decision is changed.
Legal protection should not depend on whether one has the finances to litigate for several years, speaks perfect Danish or attracts media attention.
When the state intervenes in a citizen’s finances with claims of several million kroner, a considerable responsibility follows.
And when a decision proves to be wrong, the focus should not only be on correcting the tax assessment. There should also be an eye to the financial and human consequences the case has had along the way.
